Terms of Service

Welcome to Foodissi ("we," "us," "our"), an AI-powered recipe creation and management platform available at https://foodissi.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration

  • You must provide accurate, complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at info@foodissi.com if you suspect unauthorized access.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

Foodissi uses artificial intelligence (AI) models to generate recipes, nutritional estimates, and related content based on your inputs. The Service includes:

  • AI-powered recipe generation via chat interface
  • Recipe import from external URLs
  • Recipe management (saving, editing, organizing, tagging)
  • Nutritional information estimation
  • Recipe export (JSON, PDF)
  • Cooking mode for step-by-step guidance

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

4. AI-Generated Content — Important Disclaimers

This is a critical section. Please read carefully.

All recipes, nutritional data, ingredient lists, cooking instructions, and other content generated by the AI ("AI Content") are produced by third-party artificial intelligence models. You acknowledge and agree that:

  1. No guarantee of accuracy. AI Content may contain errors, inaccuracies, or omissions. Recipes may include incorrect quantities, incompatible ingredient combinations, or unsafe preparation methods. Nutritional values are estimates only and may differ significantly from actual values.
  2. Not professional advice. AI Content does not constitute medical, nutritional, dietary, or health advice. The Service is not a substitute for consultation with qualified healthcare professionals, dietitians, or allergists.
  3. Allergen risk. AI-generated recipes may contain or suggest ingredients that could cause allergic reactions, food intolerances, or adverse health effects. The AI may fail to identify or warn about potential allergens, even when allergy or dietary preferences are specified. Always verify ingredients against your specific allergies and dietary restrictions before preparation and consumption.
  4. Dietary compliance. While the Service allows you to set dietary preferences (e.g., vegan, gluten-free, halal), the AI may not always produce recipes that fully comply with your specified restrictions. You are solely responsible for verifying that recipes meet your dietary requirements.
  5. Food safety. The AI may suggest cooking temperatures, times, or methods that do not meet food safety standards. Always follow established food safety guidelines (e.g., USDA, EFSA) for proper cooking temperatures, storage, and handling.
  6. Your responsibility. You use AI Content entirely at your own risk. You are solely responsible for evaluating and verifying the safety, accuracy, and suitability of any AI-generated recipe before preparation and consumption.

5. Intellectual Property

5.1 Our Content

The Service, including its design, code, features, branding, and proprietary technology, is owned by Foodissi and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

5.2 AI-Generated Recipes

Recipes generated by the AI through your use of the Service are provided to you under a non-exclusive, royalty-free, personal-use license. You may:

  • Save, modify, and use AI-generated recipes for personal, non-commercial purposes.
  • Share individual recipes with friends and family for personal use.

You may not:

  • Claim AI-generated recipes as original creations for commercial purposes without modification.
  • Systematically extract or bulk-download recipes from the Service.
  • Use AI-generated recipes to create a competing service or product.

5.3 Your Content

You retain ownership of content you provide to the Service, including photos, notes, and custom recipe modifications ("User Content"). By uploading User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and process it solely for the purpose of providing and improving the Service. We will not use your User Content for advertising or sell it to third parties.

6. Subscription and Payments

6.1 Free and Paid Plans

The Service offers free and paid subscription tiers. Free tier users have access to limited features and usage quotas. Paid subscriptions unlock additional functionality as described on the subscription page.

6.2 Billing

  • Paid subscriptions are billed on a recurring basis (monthly or as specified at checkout).
  • All payments are processed through Stripe, a third-party payment processor. By subscribing, you also agree to Stripe's terms of service.
  • Prices are displayed in the currency shown at checkout and may be subject to applicable taxes.

6.3 Cancellation and Refunds

  • You may cancel your subscription at any time from your account settings.
  • Upon cancellation, your subscription remains active until the end of the current billing period.
  • We do not provide refunds for partial billing periods unless required by applicable law.
  • If you believe you were charged in error, contact us at info@foodissi.com within 14 days.

6.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service or servers.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated systems (bots, scrapers) to access the Service without our written permission.
  • Upload malicious content, viruses, or harmful code.
  • Harass, abuse, or threaten other users.
  • Circumvent any usage limits, rate limits, or access controls.
  • Use the Service to generate content that is illegal, harmful, or violates the rights of others.

8. Third-Party Services

The Service may integrate with or rely on third-party services, including:

  • AI providers (e.g., OpenAI, DeepSeek) for recipe generation
  • Stripe for payment processing
  • Google Tag Manager for analytics
  • Email services for account notifications

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • We expressly disclaim any liability for harm, injury, illness, allergic reactions, or adverse health effects resulting from the preparation, consumption, or use of AI-generated recipes, nutritional information, or dietary suggestions.
  • Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Foodissi, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any harm resulting from your reliance on AI-generated content

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service ceases immediately.
  • We may delete your account data after a reasonable retention period, unless required by law to retain it.
  • Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will remain in effect.

You may delete your account at any time through your account settings or by contacting us at info@foodissi.com.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. If you are a consumer in the European Union, you also retain the protection of mandatory provisions of the law of your country of residence.

Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of Germany. EU consumers may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree with the updated Terms, you must stop using the Service and may delete your account.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Foodissi regarding the Service and supersede any prior agreements.
